A waiter of a luxury hotel located in Cabo San Lucas, Mexico got accused of sexually assaulting a doctor. The resort, however, is telling her that she is the one to blame for the attack, indicating that she ‘is guilty of inequitable conduct’ and ‘voluntarily and knowingly assumed all risks.’
The woman, whose age and identity remained anonymous, said that everything happened in her room at Hotel Esperanza in Cabo San Lucas. “I woke up. I was confused, thinking I was having a dream with somebody’s fingers inside of me,” she said.
Her attorney, Paul Llewellyn, said that they ‘should be ashamed of themselves’ and that it was outrageous how the Auberge Resorts’ stance was to blame the victim instead of taking accountability for the facts. The doctor, who is married and a mother of two, went to Cabo with other five girlfriends and planned on ending the night with Mexican dinner.
The waiter went into the room after he was done serving the rest of the group and began the attack her while she was sleeping. “I was very disoriented, as I was kind of coming to and he said something like, ‘It was part of the service.'”
Her girlfriends approached the waiter and asked the resort to call the police. The waiter, ‘wringing his hands and appearing nervous,’ admitted what he had done, saying, “Yes, I know. I’m so sorry, I’m so sorry,” said the lawsuit.
After that, the hotel manager talked to the girls and let them know that the authorities would not take any actions regarding the case. She wanted to raise awareness and claimed that since the hotel was not assuming responsibility, it was now a matter of safety for the women who are planning to visit the hotel.
The luxury resort has hosted some celebrities like Jay-Z, Vanessa Hudgens, and even former U.S. President Barack Obama.
